Traffic Law

I received a ticket. Can you make it go away?

Generally speaking, no. Although sometimes tickets are dismissed for technical reasons, you should not expect a lawyer to make your ticket go away. Although a lawyer can occasionally find a legal reason for a ticket to be dismissed, most of the time it does not happen.
If I just have to pay court costs, but I don’t get any points on my license, does that mean my ticket was dismissed?

No. If your ticket has been dismissed, you will not have to pay any fines or court costs. Judges and traffic magistrates have the option to withhold adjudication on your ticket. This means that no points are placed on your driving record. This does not mean that your ticket was dismissed. The better your past driving record is, the more likely it is that a judge will not give you the points.

I don’t have time to go to traffic school. Is there anything else I can do?

There are several State-approved driving schools that you can attend through the Internet at your convenience. There are also driving school videos that you can rent and watch at home. An attorney can provide more details.

I’ve received a lot of mail from attorneys who guarantee no points. How does that work?

No attorney can guarantee that a judge will not give you points on your ticket. The attorneys sending you this mail usually work on a high volume basis. Usually, such attorneys guarantee that if you are given points, you will not be charged for their time. See Q.2 above.

If an attorney handles my ticket, do I still have to show up in court?
No, unless your ticket requires a court appearance by you, or your attorney advises that you should attend. However, please remember that your attorney cannot testify on your behalf. If there are issues you feel you must bring to the Court’s attention, or if you want a trial, it may be necessary for you to testify in person.

My license has been suspended,
but I need it to drive to work.
What can I do?

There are many kinds of driver license suspensions and not all allow for a "work permit" It is best to consult with an attorney to see if your suspension qualifies for an exemption.
